Welcome to AtlasFit ("App"), a fitness tracking application operated by Atlas Ascent LLC ("Company," "we," "us," or "our"). By downloading, accessing, or using AtlasFit, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.

AtlasFit is designed for general wellness purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

CONSULT YOUR PHYSICIAN before beginning any exercise program, particularly if you have medical conditions, injuries, are pregnant, or take medication.

If you experience pain, dizziness, shortness of breath, or discomfort during exercise, STOP IMMEDIATELY and seek medical attention.

1. Acceptance of Terms

By creating an account or using AtlasFit, you confirm that you are at least 18 years old, or between 13–17 years old with parental or guardian consent.

2. Assumption of Risk and Release of Liability

YOU EXPRESSLY ACKNOWLEDGE AND AGREE:

Physical exercise carries inherent risks, including injury, disability, or death.
You voluntarily assume all risks associated with your use of AtlasFit.
You are solely responsible for determining whether exercises are appropriate for you.
Atlas Ascent LLC shall not be liable for injuries, damages, or losses arising from your use of the App.
You release and waive all claims against Atlas Ascent LLC arising from your use of the App.

3. No Medical Advice

Workout suggestions, AI-generated recommendations, and tracking features are informational only. They do not constitute medical advice and are not intended to diagnose, treat, cure, or prevent disease. Results may vary. We do not guarantee specific outcomes.

4. User Accounts

Account Security: You are responsible for maintaining the confidentiality of your login credentials.

Accurate Information: You agree to provide accurate registration information.

Termination: We may suspend or terminate your account at our discretion.

5. Subscription and Payment Terms

Certain features may require a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually).

Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.

Cancellation: Subscriptions must be canceled through your Apple App Store account settings.

Refunds: Refund requests must be submitted to Apple in accordance with their policies.

6. Intellectual Property

All content, software, features, branding, and materials within AtlasFit are owned by Atlas Ascent LLC and protected by intellectual property laws.

7. Prohibited Conduct

You agree not to:

Use the App unlawfully
Attempt unauthorized access to systems
Reverse engineer or decompile the App
Use automated tools to scrape or collect data
Interfere with platform integrity
Share account credentials

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS ASCENT LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless Atlas Ascent LLC from claims arising from: (a) your use of the App, (b) violation of these Terms, (c) infringement of third-party rights.

10. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association in Delaware.

You waive any right to participate in a class action lawsuit or class-wide arbitration. You waive the right to a jury trial.

11. Governing Law

These Terms are governed by the laws of the State of Delaware.

12. Modifications

We may update these Terms at any time. Continued use of the App constitutes acceptance of modifications.

13. Severability

If any provision is deemed unenforceable, the remaining provisions remain in effect.

14. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Atlas Ascent LLC.
